Present for the regular meeting of the Village of West Liberty Council on Sept. 14 were Mr. Lance, Mr. M. Hostetler, Mr. King, Mrs. Hamilton, Mrs. Coy, Mrs. McKelvey, Solicitor Moell, Police Chief Oelker, Fire Chief Hostetler, and Clerk Boyd. Absent: Mayor G. Hostetler. Guests: Tami Wenger, Debbie Piatt, Doug Oelker, Neil Adams, Cherie Squires, Gloria Thompson, Tamara Overholt, Carol Hemphill, Dianne Matthews, Richard Mally, Janet Mally, Jim Nash, Dawn Wilbur, Barb Hackett, Ben Griffith, Joann O’Brien, Chris Shafer, Beverly Yoder, James Strunk, Jeff Wolfe, Paul Ober and Lucida Ober from the facebook page “Save the West Liberty Christmas Tree.” Jeff Kelley from WPKO radio and Nate Smith from Bellefontaine Examiner were also present. Ken Windle of Wichert Insurance was present.
Meeting was opened with Pledge of Allegiance and Lord’s Prayer.
A MOTION was made by Mr. King seconded by Mr. M. Hostetler to approve minutes of August 24, 2015 was approved as written/read. Motion Carried.
A MOTION was made by Mrs. Hamilton seconded by Mr. M. Hostetler to approve the following bills in the amount of $51,517.90. Motion Carried.
Doug Oelker from the “Save the Christmas tree committee” was here to discuss to Christmas tree. He called tree trimmer, Neil Adams and asked about the condition of the Christmas tree located at the town hall. Neil Adams said the tree is in good condition and could last another 30-50 years. He would be glad to trim the tree and put new lights on it. Jeff Wolfe started the FB page and just wanted to let people know what Council and Town Hall committee decided about the tree. He thinks this Christmas tree is part of Village and part of the Christmas tradition. Debbie Paitt said the community has spoke and the Christmas tree needs to stay. Dawn Wilbur would like to see her grandkids enjoy the Christmas Tree just as her kids. She also thanked all the people that were here to support the Christmas tree. Grayson Atha, town Hall Committee would like to thank everyone who spoke this morning at Liberty Gathering Place and commented about the tree. If Council agrees there is a group that wants to raise money for new lights, trim tree and bury electric for the Christmas Tree. The Village of West Liberty would not be responsible for any funding for the Christmas tree but the tree must be done by November 15, 2015. The paving work and downspouts will be done around the tree if council decides to remove the tree there is another tree on the other side of the town hall that is very nice. Paul Ober spoke about the sentimental attachment this tree means to everyone. He and his wife would like to set up a fund to allow everyone to save the tree and put new lights on it. They want to make it a “WOW” factor in the West Liberty. They also would like to raise funds to restore the opera house. Mr. Lance, acting Mayor asked Council to rescind their motion or give comments about the Christmas Tree. Mr. M. Hostetler thought the tree is too big but has never seen anything in writing about the tree. Mrs. Mckelvey wants everyone to stay involved with Town Hall, Christmas tree, Council and Village committees. Mr. King would like to see it removed to let the Town Hall committee do the pavers and landscaping as they wanted. Mr. Lance would like to keep the tree considering the new facts that have been brought here tonight.
A MOTION was made by Mr. M. Hostetler seconded by Mrs. Coy to rescind the motion made at the last meeting to remove the tree. Yeas: 4 Nays: 1 Abstain: 1.
Liberty Township needs to be aware of the decision and vote to remove or save the tree. Council would like to remind everyone that is here 2017 will be coming soon and a committee needs to be formed to celebrate the sequential. Everyone was very respectful and kind. Council would like to thank everyone for that.
Ken Windle, Wichert Insurance was here to explain the liability insurance. Westfield insurance increased their rates by about $6000.00. EMC insurance company came back at $1000.00 deductible with a quote of $34264.00 for public officials, liability, etc. A MOTION was made by Mrs. McKelvey seconded by Mr. M. Hostetler to allow EMC to be our liability insurance company. Motion Carried. L
Police Chief Oelker and Fire Chief looked at the grade school building on W. Columbus. A letter will be sent by the Clerk with copies of ordinances. There is a hole in the roof and kids are getting in the coal shoot and shooting paintballs inside the building.
Fire Chief Hostetler said the fire rescue truck was damaged and the cost the repair is about $5800.00 but it was not our fault.
Police Chief Oelker is moving forward about looking into tearing down the police house and building a new one. Zoning officer has denied the building permit. A variance will be turned in ASAP.
Clerk has turned in and created a welcome packet card for garbage, brush, recycling, etc. Should have them by the end of the week.
There are several properties needing cleaned up, parking lots needing leveled, etc.
The property on CR 189 has been approved to annex by County Commissioners, Council has to approve or not approve this annex after November 9, 2015.
Clerk will schedule an annual meeting with township trustees soon.
Ordinance 2015-11 entitled “ An Ordinance Establishing that sidewalks be construction and maintained in all residential and Business Areas of the Village of West Liberty, Logan County, Ohio” was read. A MOTION was made by Mr. M. Hostetler seconded by Mr. King to adopt Ordinance 2015-11 on 3rd and final reading. Motion Carried. Yeas: 4 Nays: 0.
Ordinance 2015-13 entitled “ An Ordinance Amending Ordinance 2015-08 regulating trees in the Village of West Liberty, Logan County, Ohio” was read. A MOTION was made by Mr. Hostetler seconded by Mr. King to pass Ordinance 205-13 on first reading only. Motion Carried. This Ordinance is amending the tree Ordinance to include alleys.
Resolution 2015-14 entitled “A Resolution Authorizing Gregory J. Hostetler, Mayor to Prepare and Submit an Application to participate in the Ohio Public Works Commission State Capital Improvement and/or Local Transportation Improvement Programs and to Executive Contracts as Required” was read. A MOTION was made by Mr. Hostetler seconded by Mrs. Hamilton to adopt resolution 2015-14 on first and final reading. Motion Carried. This OPWC application is for UV System for the water department.
Resolution 2015-15 entitled “ A Resolution Accepting the Amounts and Rates as Determined by the Budget Commission and Authorizing the Necessary Tax Levies and Certifying them to the County Auditor” was read. A MOTION was made by Mrs. Hamilton seconded by Mrs. Coy to adopt Resolution 2015-15 on first and final reading. Motion Carried.
Resolution 2015-R16 entitled “A Resolution Authorizing Cooperative Agreement for Construction Maintenance and Operation of State Water Project Between Village of West Liberty, Ohio and the Ohio water Development Authority and Declaring an Emergency” was read. A MOITON was made by Mrs. Coy seconded by Mr. Hostetler to adopt resolution 2015-R16 on first and final reading. Motion Carried.
Resolution 2015-17 entitled “A Resolution Authorizing Gregory J. Hostetler, Mayor to Prepare and Submit an Application to participate in the Ohio Public Works Commission State Capital Improvement and/or Local Transportation Improvement Programs and to Executive Contracts as Required” was read. A MOTION was made by Mr. King seconded by Mr. Hostetler to adopt resolution 2015-14 on first and final reading. Motion Carried. This OPWC application is for curb and gutter work on SR 68/Zanesfield Rd.
Solicitor Moell has the bid packet for garbage pickup and will get it back to Clerk with corrections.
